New DC Guidance Targets Utility Fees and Transparency in Rental Housing

The DC Office of the Attorney General has issued an updated consumer alert and business advisory focused on utility billing practices in apartment buildings, emphasizing the need for clear, transparent, and complete fee disclosures—particularly as more properties use Ratio Utility Billing Systems (RUBS).

A key section, “Tips for Multi-Unit Property Owners: Do Not Charge Illegal Fees and Clearly Disclose All Fees,” reiterates that District law prohibits landlords from charging tenants fees for services they are already legally required to provide as part of a habitable rental unit. This includes administrative or service fees tied to utility access, such as billing, metering, or account setup and maintenance.

The alert also outlines expectations for DC property owners using RUBS, providing guidance on compliance and disclosure requirements.
